The Jack’s Privacy Policy (“Privacy Policy”) applies to your access and use of our websites at https://www.eatatjacks.com and https://www.ordernow.eatatjacks.com, our mobile websites, our mobile applications, any other platforms that link to this Privacy Policy (the “Jack’s Online Services”), and any other means by which we may collect information about you, including information you may provide to us onsite at one of our restaurants (collectively, with the Jack’s Online Services the “Jack’s Services”). Our website and mobile applications may offer links to websites and/or other mobile applications that are operated by third parties and not by Jack’s. If you visit one of these linked websites, you should read the website’s privacy notice, terms and conditions, and their other policies. We are not responsible for the policies and practices of third parties. Any information you give to those organizations is governed under their privacy notice, terms and conditions, and other policies.

By downloading or using any of the Online Services, you are agreeing that you have read and agree to be bound by this Privacy Policy, our Terms and Conditions of Use, and consent to our collection, use, disclosure practices, and other activities described in this Privacy Policy. If you disagree with any part of this Privacy Policy or our Terms of Use, then please do not use any of the Online Services.

This Privacy Policy describes the types of personal information that Jack’s collects, how we use it, how and when it may be shared, and the rights and choices you have with respect to your information. It also explains how we communicate with you and how you can make requests or submit inquiries to us about your information. Our goal is to help you understand how we use your information to improve our products, services, marketing, and interactions with you, as part of our commitment to maintaining your trust.   1. Information We Collect.

Information You Provide  

Whether accessing the Jack’s Services from your home computer, mobile phone, or other device, Jack’s and its agents collect information you directly provide. For example, we collect information when you register an account, join our reward program, enroll in our mailing lists or text message campaigns, locate a restaurant, apply for a job, interact with Customer Care, or otherwise communicate or transact with us through the Online Services.

The information we collect includes information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you (“personal information”). The categories of information we collect, includes the following:

  • Name and Contact Data – We collect your first and last name; mailing address; telephone number; e-mail address, and other similar contact data.
  • Credentials – We collect username and password, and similar security information (for account authentication and administration).
  • Demographic Data – We collect information about your interests and activities, your gender, month and day of birth, and other demographic information.
  • Payment Data – We collect data necessary to process your payments if you make purchases through the Online Services, such as your financial account information and other payment information, or other forms of payment.
  • Contacts – In some cases, and with your consent, we collect information that you provide about others, including first and last name, email address, and phone number of your personal contacts, such as when you send your contacts benefits, coupons, or gifts. We will use the information you provide to fulfill your requests, including (if applicable) sending them a text message, and we will not send marketing communications to your contacts unless they have a separate relationship with us. Such functionality is intended only for United States residents. By using this functionality, you acknowledge and agree that both you and your contacts are based in the U.S. and that you have your contacts’ consent for us to use their contact information to fulfill your request.
  • Content – We collect the content of messages you send to us, such as feedback and information you provide to customer service. We also collect the content of your communications as necessary to provide you with the Jack’s Services you use.
  • Contests/Promotions – We collect additional information necessary for the administration of certain promotional events or features of our reward program.
  • Resume Data – We collect data as necessary to consider you for a job opening if you submit an application to us, such as your employment and education history, transcript, writing samples, and references.

You may choose to voluntarily submit other information to us through the Jack’s Services that we do not request, and, in such instances, you are solely responsible for such information. Therefore, you should take steps to prevent the communication of unnecessary information when accessing the Jack’s Services using voice functionality services.

Information once “de-identified” is not subject to this Privacy Policy and we may treat it as non-personal Information and use it without obligation to you except as prohibited by applicable law.

Information Collected Automatically 

In addition, we automatically collect information about your device and how your device interacts with the Jack’s Online Services. We also use service providers and business partners to collect this information. The categories of information we automatically collect, includes the following:

  • Service Use Data – We collect data about the features you use, the pages you visit, the e-mails and advertisements you view, the products and services you view and purchase, the time of day you browse, your referring and exiting pages, and other similar information.
  • Device Connectivity and Configuring Data – We collect data about the type of device or browser you use, your device’s operating software, your internet service provider, your device’s regional and language settings, and other similar information: This data also includes IP address, MAC address, device advertising ID (e.g., IDFA or AAID), and other device identifiers.
  • Location Data – We collect data about your device’s location, which can be precise (e.g., latitude/longitude data) or imprecise (e.g., location derived from an IP address or data that indicates a city or postal code level).

We use various tracking technologies to automatically collect information (“Tracking Technologies”), when you use the Jack’s Online Services, including the following:

  • Log Files – A log file is a file that records events that occur in connection with your use of the Jack’s Online Services, such as your service use data.
  • Cookies – Cookies are small data files stored on your device browser directories to store your information about your use of the Jack’s Online Services and your activities online (collectively, “Cookies”). A Cookie will typically contain the name of the domain (internet location) from which the Cookie has come, the “lifetime” of the Cookie (i.e. when does it expire), and a value, usually a randomly generated unique number. We use Cookies so that we can improve your online experience – for example, by remembering you when you come back to visit us and making the content you see more relevant to you. Cookies also enable us to track online purchases made through the Jack’s Online Services.
  • Pixel Tags (“Web Beacons” or “clear gifs”): Pixel Tags are small graphic images, also known as “web beacons” or “clear gifs,” embedded in web pages, e-mail messages, video, or advertisements that send information about your use to a server. There are various types of pixel tags (which contain JavaScript code). When you access or view a website, video, email, or advertisement that contains a pixel tag, the pixel tag permits us or a separate entity to drop or read cookies on your browser. Pixel tags are used in combination with cookies to track activity by a particular browser on a particular device. We incorporate pixel tags from separate entities that allow us to count the number of visitors to the Jack’s Online Services, to monitor how users navigate the Jack’s Online Services, to count content views, bring you advertising both on and off the Jack’s Online Services, including geographically relevant advertising based on your IP address, and provide you with additional functionality, such as the ability to connect the Jack’s Online Services with your social media account.
  • Embedded Scripts – An embedded script is programming code designed to collect information about your interactions with the Jack’s Online Services. It is temporarily downloaded onto your device from our web server or a separate entity with whom we work, is active only while you are connected to the Jack’s Online Services Online Services, and deleted or deactivated thereafter.
  • Location-identifying Technologies – GPS (global positioning systems) software, geo-filtering, Bluetooth, beacons, and other location-aware technologies locate you (sometimes precisely) for purposes such as verifying your location and delivering or restricting relevant content based on your location. An example of how we may use location-aware technologies is, if you have enabled location services on your device with respect to the Jack’s Online Services s, we may use your real time geographic location data to determine if you are near a one of our restaurant locations, to predict your arrival time at our drive-through or pick-up counter after you have placed an order, allowing our restaurants’ crew members to better sequence your order, or to send you advertising or promotions via push notifications. We may also associate your location captured via location-aware technologies with your device identifier and combine that data with transactional information to improve the services offered to you. You may limit access to your location data by adjusting the permissions in your device. If you grant us permission, we may collect location information when the app is running in the foreground or background.
  • In-App Tracking Methods – There are a variety of tracking technologies that may be included in mobile apps, and these are not browser-based like cookies and cannot be controlled by browser settings. Some use device identifiers or other identifiers such as mobile Ad IDs to associate app user activity to a particular app and to track user activity across apps. Our apps may also include Software Development Kits or “SDKs,” code that sends information about your use to a server. These SDKs allow us to track our conversions, bring you advertising both on and off the Jack’s Online Services with your social media account. For example, we use the Facebook SDK to allow you to connect your Facebook account to the Jack’s Online Services.
  • Connected Devices – We use technology in connected devices, including your vehicle, home assistant, or smartwatch, to determine your location, serve advertising, or provide promotional offers. Information we collect through your connected devices will depend on the device and your settings, but may include voice, location, payment information, or biometric data. We also associate the information from connected devices to your device identifier and combine that with transactional information to improve the services offered to you.   • Some information about your use of the Jack’s Online Services and other sites and apps may be collected using Tracking Technologies across time and services and used by us and others for purposes such as to associate different devices you use, and deliver relevant ads and/or other content to you on the Jack’s Online Services and certain other sites and apps.

Information from Other Sources 

We also receive information about you from other sources. For instance, we receive information about your purchases and inquiries from payment processors. To the extent we combine such sourced information from other sources with information we have collected about you through the Jack’s Online Services, we will treat such information in accordance with this Privacy Policy, plus any additional restrictions imposed by the source of the data. The categories of sources from which we have collected information in the last 12 months include the following:

  • Data brokers or resellers from which we or our vendors purchase demographic data and geolocation information to supplement the data we collect.
  • Social networks when you reference Jack’s or our Jack’s Online Services, or grant permission to Jack’s to access your data on one or more of these services.
  • Publicly-available sources such as open government databases or other data in the public domain.
  1. How We Use Your Information.

We use information that we collect about you or that you provide to us, including any personal information, for various purposes, including, without limitation, to:

  • Providing our products or services to you.
  • Communicating with you.
  • Customizing and improving your experience.
  • Creating and maintaining your accounts with us.
  • Getting to know you.
  • Marketing and advertising.
  • Fraud detection, security, legal enforcement, and compliance.

The usage information we collect helps us to improve our Jack’s Online Services and to deliver a better and more personalized experience by enabling us to estimate our audience size and usage patterns, store information about your preferences and customize our Jack’s Online Services according to your individual interests, speed up your searches, and recognize you when you use the Jack’s Online Services. Jack’s does not sell, share, trade, or give away personal information. Personal information, however, may be shared for use in internal marketing research. Gathered information may be transferred to a new app platform without notice if the need arises.

  1. Aggregate Statistics.

We may aggregate your personally identifiable information, either alone or with other data, to create anonymous “aggregate data” regarding the users of our services. Aggregate data is information that describes the habits, treatment plans, usage patterns, or demographics of users as a group but does not reveal the identity of particular users. This data will not identify you but will be used by Jack’s internally as statistical information to determine such things as user demographics and usage patterns of our services. We may use aggregate data to understand the needs of our community of users, to determine what kinds of programs and services we can help provide, and to improve and enrich our products, services, and Website content.

  1. How We Disclose Information We Collect.
  • Service Providers – We disclose information to entities that process the information on our behalf. These service providers provide us with services such as website hosting, professional services, information technology services and related infrastructure, customer service, marketing, e-mail delivery, auditing, and other similar services. We endeavor to contractually prohibit our service providers from retaining, using, or disclosing information about you for any purpose other than performing the service for us, although we may permit them to use information that does not identify you (including information that has been aggregated or de-identified) for any purpose except as prohibited by applicable law.
  • Business Transactions – We reserve the right to disclose information in connection with, or during negotiations of, any proposed or actual corporate reorganization, merger, sale, joint venture, assignment, purchase, transfer or any other disposition or acquisition or business combination of all or any portion of our business, assets or stock, including in connection with any bankruptcy or similar proceedings.
  • Other Legal Reasons – In addition, we use or disclose information as we deem necessary or appropriate: (1) under applicable law, including laws outside your country of residence; (2) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (3) to comply with subpoenas and other legal processes; (4) to pursue available remedies or limit damages we may sustain; (5) to protect our operations or those of any of our affiliates; (6) to protect the rights, property, life, health, privacy, safety or property of Jack’s, our affiliates, you and others; and (7) to enforce our terms and conditions.
  • Facilitating Request – We share information at your request or direction, such as when you choose to share information with a social network about your activities on the Jack’s Online Services.
  • Consent – We share information for any other purpose disclosed to you and with your consent.

Without limiting the foregoing, in our sole discretion, we may share aggregated information which does not identify you or de-identified information about you except as prohibited by applicable law.

  1. Social Networking Sites. If you log into Jack’s Online Services through other third party services not operated by Jack’s, Users give Jack’s permission to access certain information about them from that social networking site, such as User ID’s, user profiles, friends lists, and profile pictures.

Jack’s Online Services may offer you the ability to share personal information through a social networking site using such site’s integrated tools (e.g., Facebook’s “Like” button, or X’s “Post” button). The use of such integrated tools enables you to share personal information about yourself with other individuals or the public. For more information about the purpose and scope of data collection and use in connection with such social networking sites or a site’s integrated tools, please visit the privacy policies of said social networking sites.

  1. Protection of Certain Personal Information.

Jack’s discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Jack’s behalf or to provide services available at Jack’s Online Services, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Jack’s Online Services, you consent to the transfer of such information to them. Jack’s will not rent or sell potentially personally-identifying and personal information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, Jack’s discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Jack’s believes in good faith that disclosure is reasonably necessary to protect the property or rights of Jack’s, third parties or the public at large. If you are a registered user on a Jack’s Online Service and have supplied your email address, Jack’s may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Jack’s and our products. We primarily use our various websites and social presences to communicate this type of information, so we expect to keep this type of email to a minimum. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Jack’s takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personal information.

  1. Data Security.   

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Jack’s Online Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

  1. Retention.

Jack’s stores information as reasonably necessary and proportionate to accomplish the purposes identified in this Privacy Policy based on criteria such as the length of time we need to provide the services to you, and to meet legal requirements, including record retention, resolving disputes, and enforcing our agreements. Our retention of your information is governed by applicable law.

  1. Your Choices.

We strive to provide you with choices regarding the personal information you provide to us. We provide you with the opportunity to update and/or delete certain information and to opt-out of having your personal information used or disclosed for certain purposes. For example, you may:

  • Correct, update, and delete your online accounts.
  • Change your choices for subscriptions and certain communications, such as email or text.
  • Request that we do not share your personal information with third parties for their marketing purposes.
  • Request access to your personal information.
  • Set your browser settings to refuse all or some browser cookies.

However, if you choose not to allow Jack’s to collect and us your personal information, note that some features or services may not be available to you.

  1. Accessing and Correcting Your Personal Information. You can review and change your personal information by logging into Jack’s Online Services and visiting your account profile page. You may also contact us by email to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Jack’s Online Services, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Jack’s Online Services users. Proper access and use of information provided on the Jack’s Online Services, including User Contributions, is governed by our Terms and Conditions of Use.

  1. Children’s Privacy. Jack’s Online Services are not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13, If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us.
  2. Your State Privacy Rights.

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose (excluding Iowa and Utah).
  • Data portability.
  • Opt-out of personal data processing for:
    • targeted advertising (excluding Iowa);
    • sales; or
    • profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).
  • Either limit (opt-out of) or require consent to process sensitive personal data.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We may modify or update this Privacy Policy from time to time to reflect changes in our business and practices, so you should review this Privacy Policy periodically. When we change this Privacy Policy in a material manner, we will so indicate by updating the “last modified” date in the heading of this Privacy Policy. Your continued use of the Jack’s Services after any change in this Privacy Policy will constitute your acceptance of such change. If you object to any changes in this Privacy Policy, you may close your account associated with the Jack’s Services.

California Consumer Privacy Act

For residents of California, this section supplements the other portions of this Privacy Policy and explains the types of personal information we collect, use, and share along with certain rights under the California Consumer Privacy Act (“CCPA”).

To provide the features of the Jack’s Online Services we process personal information whether or not you are logged into the Jack’s Online Services.  As described above, we may share your personal information for business purposes either with your permission or otherwise where permissible under the CCPA.  We will not sell any of your personal information.

Below is a summary of categories of personal information we intend to collect from or about our subscribers over the next 12 months, as well as some information about how we use it and ways we may have shared it.

Categories of Personal Information Jack’s has Collected:

  • Identifiers (e.g., name, mailing or email address, phone number).
  • Internet or other electronic networking activity information (e.g., browser or search history).
  • Financial information.
  • Location-related information including your precise device location if you choose to allow us to collect it.

You may exercise your rights personally or appoint and authorized agent to exercise your rights on your behalf.  We may request that your authorized agent has written permission to act on your behalf.  In order to verify the identity of your authorized agent, we may need to collect personal information from the agent, such as a government issued ID.
